    I said NO to the informal conference before the protest hearing. I just submitted my protest form yesterday - is there any way for me to change that answer? I had a very successful protest last year. Basically, my realtor found a close to exact comparable house in my neighborhood, which sold for my much less than my appraisal. The only major difference was that house was on a bigger lot, so I took their sale price and subtracted a bit for my smaller lot, and that was the value I entered on the form (yes I did enter a number). I filed online, and I almost immediately got an initial offer online that was only trivially lower, so I rejected that. A short time before my scheduled hearing, I got another online offer that was about the same as the number I entered on the form (actually a bit lower), and I accepted that offer and didn't have to go to a protest hearing. I actually had a successful protest two years ago too, but it was really easy. I had just bought my house at the very end of 2021, so I just sent them proof of my purchase price, and they lowered my appraisal to a bit below that.

    You are protesting the wrong issue! Don’t protest the amount…protest where the authority comes from. In a brief, taxation of your non commercial property is being misapplied by your county under the color of law. Protesting the amount of the tax in essence is saying you think the tax is ok, just not the amount. Taxes are handled locally, not by the state. Constitutionally speaking, the state has no inherent power to impose taxation on your non commercial property used as shelter. If the state has no power, there is no power that can be passed to your county. This is an extensive research of Federal and State Constitutions, State Statutes, State Administrative Codes, Blacks Law, American Jurisprudence, and case law already decided by competent courts. The research is based on Florida law and your state too will have similar laws being that all states must be in compliance with the law of the land…the united States Constitution.

    Hi Tammy, Great video. I iFile each year. This year, like last year, they lowered my market but not my appraised value. The offer points out that the taxes will be based on the lower of the two (Market and Appraised). Since my Appraised value is lower the protest (probably all due to the homestead exemption) did me no good since all they lowered is the Market value. That has happened the last two years. Is that normal? Should I take it to the next step?

    Some expert. Property tax is NOT LAWFUL! No signed assessment, it's is not a duty, impost or excise. Your home has no situs to a commercial activity. The Constitution states CLEARLY! NO ONE MAYBE HAVE PROPERTY TAKEN WITHOUT JUST COMPENSATION. Property tax is for PUBLIC USE. MEANING EMINENT DOMAIN APPLIES, YOU ARE ALL BEING PLAYED AS IGNORANT MASSES WHO CAN NOT READ...     Stop arguing the amount! Learn your rights people. You have both state and federal constitutionally protected rights to own property. Your home is a Non Commercial Property. THE ONLY TAXES THAT CAN BE IMPOSED ARE IMPOST, EXPOST, AND EXCISE. You home is being taxed under excise, which is a privilege tax. Owning a home to provide shelter where no business is being conducted is a right! Not a privilege!

    Start with the definitions for that title. The definition for person is a corporation, trust, association, et.al. In order for a property in any of the 50 states to be taxable, it has to have a situs (place of a crime or business) attached to it, in other words it has to be producing a profit. Through a return required by the Florida Department of Revenue for businesses, that is then sent to the property appraiser to notify of a privilege being conducted in the state. The homestead exemption is an application to exclude your “place of shelter” and exempt it from the portion of your property that is exercising a privilege, to operate in commerce in the state. Regardless of what the PA classifies your home as, it is not taxable and it is the intent of the Florida Legislature to be in compliance with the Constitution of the United States. Taxes are handled at the local level. It is the intent of the Florida Legislature to be in compliance with the US Constitution. Go ask your PA to show you what statute shows you are a taxpayer and the proof they have that shows you are operating in commerce. Bet they send you to talk to the county attorney.

    My grandfather protested every year period. He died at the beginning of this year and my grandmother was left with the house with my mother and aunt basically in charge of everything. They haven’t protested because he was a 100% service connected Disbaled so they don’t have a tax liability and my grandmother is granted surviving spouses benefits and as a result they don’t think they should protest the appraisal

    The appeal board told me this year (2022) that they only do Market Value, not the assessed value, which is BS. They did not consider estimates, drainage issues, window issues and sprinkler systems issues. They said it does not have much value. Well it does if you are selling, which I am not. I did get $20k off Market value which means nothing to me AND increased the Improvement value $15k. I asked them why didn't Over 65 increase since everything else did, they could not answer. The comps they provided was not comparable to my home and had bigger sq ftage. They took WHAT WAS SOLD. Because I had a realtor run comps. Only one home has sold in this subdivision in the last 6 months. I do not see how the sale of one home can increase the value of my home by $50K and the Land by $20K. Yet, DCAD states that my home has depreciated by 45%. They told me since my house was 1983, they wanted pictures of 1983 kitchen and baths with avocado deco and such, never been updated. REALLY? IT IS RIGGED!

    Appraisal districts are setup to screw homeowners. Our property value jumped from $1.1 to $2.24 million, more than double. at $302/sq foot, I have numerous examples of comparable homes for around $100/sq feet and they barely budged on ours. Will be going to court on this.

    I’m so sorry to interrupt, but that is false information. If you own a home on private property in the state of Florida and that private personal property is in NO WAY ASSOCITATED WITH AN ACT OF COMMERCE or profit producing activity….there is no tax due at all! Your shelter is not taxable. The exemption you are applying for it to separate your homestead from the peroration of your property that is operating in commerce. Start researching!

    Does the judge during a formal appeal process see pictures of your property from MLS? Or do they pull from Zillow/Redfin...etc? The reason is because my public pictures were posted by me after an improvement, so it would be unfair to evaluate a property based on "after repair value"

    Because of EQUAL & FAIR APPLICATION of law and taxation, combined with the inalienable right to the pursuit of happiness (meaning PROPERTY, which is why the constitution requires the govt to make sure all American's have a realist way to buy their own property, it has to be reasonably obtainable), I'm wondering if this was ever even a legitimate power of the govt alter our property tax value then force us to pay what THEY DECIDE?!?! We ONLY pay taxes on everything else we own when we ORIGINALLY PURCHASED the items so WHY IS THE GOVT SAYING OUR PROPERTY VALUE is to be repeated taxed and the tax can increase at their discretion whenever they want to collect for all of time? They can easily say my home has increased $100K if they don't like me OR they want to STEAL my property away, and then say their political party associates property in the same area stayed the same, so their associates don't pay higher taxes but their political rivals pay an unfairly high amount. And what about the unfortunate people who have a catastrophic financial event and the soaring property taxes were just enough to default them - then are they no longer afforded the right to happiness/property CAUSE THE GOVT BEEN GETTING HAPPY SEIZING PROPERTY FOR TAX LIENS, so...... Then.... Are we really to believe the govt to intentionally cause inflation, intentionally cause a hurting economy (unconstitutional lockdowns & illegal employer discrimination while outsourcing manufacturing) and we now that govt has been widespread STEALING money out of these county tax accounts, AND THIS IS ALL CONSTITUTIONALLY OKAY WE ARE TO BELIEVE 🤨 OR is it like Hawaii saying you must have a license to have a gun but got sued and was educated that the BILL OF RIGHTS HAS A GUARANTEED SECTION ♥️ the 2nd amendment. Hawaii was forced to remove their unconstitutional law and honor our supreme right! I think this is a great example of what we are experiencing now with the property tax!

      Reading old wills they word real property like "...passed down to my heirs FOREVER" unless they chose to sell the property to new owners of course; some even say how much they paid for the land originally and say as long as them or their rightful HEIRS OWN THAT PROPERTY THE VALUE WILL FOREVER REMAIN THE SAME PRICE IT WAS PURCHASED FOR OR APPRAISED FOR, LOCKED IT, CANNOT GO UP WITH THE OWNERS CONSENT BECAUSE THEY ARE AFTER ALL THE OWNER!!!!! REGARDLESS OF GENERATIONS PASSED DOWN THROUGH NEXT OF KIN, unless the heirs chose to have an appraisal done or sell at their discretion. And really this makes absolute sense, if I own my property and I'm not selling it, that I say it's ZERO VALUE CAUSE ITS NOT ON THE MARKET, NOT FOR SALE! IT'S MINE, ALL MINE, AND I HAVE NO INTENTION ON SELLING IT SO ITS NOT UP FOR DEBATE, if they have any reason that's justifiable for needing to give a value without my consent then the ONLY value FAIR & REASONABLE is the value it was when I bought it! Not a penny more as long as I or my heirs remain the owners!!! This is a strong case as well because ONLY when a thorough appraisal is done inside and out of the property which is normally done during a sale, can detailed appraisal be evaluated and it's fairness is evidenced by the closing of a sale because who better to decide if the appraised value is fair than the seller who benefits from a higher appraised value and buyer who benefits with a lower price - that harmony brings a happy balance to the fair value. It makes sense then that the ONLY value can be the one at the time of the original sell regardless of how long it's been since the sell took place - if it's not for sell then it's value is NULL now isn't it, and there's NO way govt can legally prove that they are in compliance of the fair and equal representation/application of taxes state wide when right now it's up to govt agents discretion, and are likely to benefit by abusing their discretion.
